Kim Zolciak is speaking out after her 15-year-old son, Kroy “KJ” Biermann Jr., was arrested on serious charges.
The Real Housewives of Atlanta alum issued a statement through her rep after KJ, whom she shares with estranged husband Kroy Biermann, was arrested in Alpharetta, Georgia, on charges of aggravated sodomy and aggravated sexual battery.
The allegations stem from an alleged incident involving a female classmate in a gym changing area on April 23.
In a statement to Page Six, Kim’s rep strongly denied the allegations on KJ’s behalf.
“The allegations being made against my son are nothing short of reckless and deeply troubling,” the statement read.
Kim’s rep continued, “He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.”
According to Kim’s statement, KJ voluntarily took and passed a polygraph examination regarding the allegations.
“Additionally, an examination was conducted, and no DNA belonging to my son was found,” the statement continued.
Kim’s rep also claimed they are aware that the accuser has made similar allegations involving two other people, which they believe “raises serious concerns that deserve to be carefully examined.”
The statement stressed the damage that false accusations can cause, while also acknowledging the importance of taking real allegations seriously.
“False accusations can have devastating consequences, not only for the accused, but also for genuine survivors of sexual assault and abuse,” the statement read.
Kim’s rep added, “Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation.”
The statement concluded by asking the public to let the legal process play out.
“We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations.”
KJ’s attorney, Jason Sheffield, also issued a statement to Page Six, saying his client is “100% innocent.”
According to Sheffield, KJ tried to provide evidence to the arresting officer, including a passed polygraph from what the attorney described as a respected sex offender polygrapher, as well as evidence of what he claims are prior false allegations by the alleged victim.
Sheffield also pointed to the police report, saying the Georgia Bureau of Investigation found no male DNA in the areas where the alleged victim claimed she was assaulted.
“The fact that he’s been arrested and is being held without Bond is a tragedy,” Sheffield said. “He is not only presumed innocent, but is in fact, innocent.”
He added, “I’m asking the Public not to presume the truth of these allegations and to give the families on both sides their space and privacy.”
According to court documents, the alleged victim accused KJ of assaulting her while they were in a co-ed sauna. The alleged victim claimed KJ forced himself on her despite her saying no.
Court documents also claim KJ allegedly attempted “multiple times to have sexual intercourse with her by trying to pull down her pants.” The alleged victim also accused him of forcing oral sex and digitally penetrating her.
The alleged victim claimed she eventually got away, after which KJ allegedly pulled up his pants and left.
According to the court papers, the alleged victim did not immediately tell anyone about the alleged assault. The following day at school, she allegedly ran into KJ’s girlfriend, left campus and went to a Starbucks, where she contacted her family and said she was having a panic attack.
She later underwent an examination at North Fulton Hospital in Georgia. According to the police report, the April 24 examination showed no evidence of male DNA in her mouth or vagina.
KJ was taken into custody on August 19 and is currently being held without bond at the Juvenile Court of Fulton County.
He is scheduled to appear in court on September 1.
The case comes as Kim and Kroy remain in the middle of a bitter and highly publicized divorce. The former couple has been dealing with ongoing financial issues, legal disputes and family turmoil for months.
Now, Kim is asking the public not to rush to judgment as her son faces serious allegations.
