The Real Housewives of Miami personality and plastic surgeon is being sued by an anonymous woman who alleges that she was sexually assaulted after being given what she claims was a sleeping pill at his Miami home. Hochstein is strongly denying the accusations and says he intends to fight the claims in court.

According to a complaint obtained by PEOPLE, the lawsuit was filed on June 5 and alleges sexual battery. The alleged victim’s identity is being kept anonymous.

In the filing, the woman claims she was the victim of a “calculated, pre-planned scheme devised and directed by [Hochstein] to lure women to his home under false pretenses.”

The woman alleges that she was “unconscious, physically helpless, and/or mentally incapacitated” after Hochstein allegedly gave her an Ambien, which she claims he described as a “very common sleeping pill.”

The lawsuit further alleges that their “sexual contact” was “unwelcome, non-consensual [and] harmful,” and that the woman was “incapable of giving, and did not give, valid consent to any sexual contact.”

Hochstein’s attorney, Lorne Berkeley, responded to the allegations in a statement to PEOPLE, saying the plastic surgeon “categorically denies the allegations.”

Berkeley also claimed that Hochstein’s legal team has evidence they believe contradicts the woman’s claims.

“Dr. Hochstein intends to vigorously defend himself and present evidence demonstrating that the allegations are false. This evidence includes video footage from shortly after the alleged incident that is wholly inconsistent with the narrative alleged in the complaint,” Berkeley said.

The attorney went on to describe what he claims the footage shows.

“The video shows the plaintiff leaving Dr. Hochstein’s home, smiling, speaking with him as she exits, briefly dancing outside the front door, and then voluntarily walking to an Uber,” Berkeley claimed.

He also alleged that there were messages exchanged after the alleged incident.

“There are also numerous post-incident text messages in which the plaintiff continued communicating with Dr. Hochstein, asked about his plans and attempted to see him again,” Berkeley claimed.

Hochstein’s attorney also claimed that before the lawsuit was filed, there had been demands for settlement discussions.

“In addition, before filing suit, there were demands for ‘good faith settlement discussions’ after threats of claims for sexual assault and defamation. Those monetary demands were made in July 2025,” Berkeley claimed.

The attorney added that Hochstein “looks forward to presenting the evidence in court and exposing the true nature and motivation behind these allegations, which we believe are false and financially motivated.”

According to the lawsuit, the alleged incident took place on May 1, 2025. The woman claims she met a “younger man” at Sopra Club in Miami Beach, who allegedly “worked to gain her trust” before inviting her to what he described as an “exclusive afterparty.”

However, according to the filing, when she arrived, “there was no party,” and she was soon left alone with Hochstein inside his home.

The woman alleges that Hochstein gave her a tour of the house that ended in his bedroom around 3 a.m. The filing states that they kissed, but she “immediately told [him] that things would not go any further and that she would not be having sex with him.”

According to the complaint, Hochstein allegedly “urged her to stay” the night and offered her what he described as a “very common sleeping pill” after she said she “might have trouble sleeping in a stranger’s bed.”

The lawsuit claims, “Approximately 15 minutes after [the woman] ingested the pill, [Hochstein] began making increasingly aggressive and continuous sexual advances toward [her]. [She] firmly refused each of [his] advances.”

The filing further alleges that the woman again told Hochstein “that she would not be having sex with him,” and that he “suggested that he could perform oral sex on [her], which she expressly declined. Immediately after [she] rejected [his] offer to perform oral sex, [she] lost consciousness and blacked out.”

The woman claims she has “no memory of any events from the time she lost consciousness until the morning.”

According to the complaint, she felt “extremely hazy” the next morning. The lawsuit alleges that Hochstein then “attempted to have sex with her,” at which point she “realized that her underwear had been removed from her body at some point during her period of unconsciousness.”

The filing claims Hochstein allegedly told the woman “that she should have sex with him because the two of them had already had sex the night before.”

The woman alleges she has suffered “severe emotional distress” as a result of the alleged incident, including “debilitating anxiety, recurring panic attacks, post-traumatic stress [and] depression.”

Hochstein also reportedly denied the allegations in a statement to Us Weekly.

“I absolutely did not drug anyone. I did not rape anyone and would never do that in my life,” Hochstein said.

He added, “No one from the police has reached out to me.”

Lawyers for the alleged victim did not immediately respond to PEOPLE’s request for comment.

Hochstein has been heavily featured in the Bravo world due to his long and contentious divorce from Real Housewives of Miami star Lisa Hochstein. Their split has played out publicly over the last several years, with legal battles, dating drama and financial disputes becoming major storylines surrounding the former couple.

These new allegations are separate from Hochstein’s divorce drama and remain allegations at this stage. Hochstein has not been found liable or convicted of any crime in connection with the lawsuit.

For now, Hochstein is denying everything and says he plans to present evidence in court.

The case is expected to play out through the legal system, where both sides will have the opportunity to make their arguments.
