What Are the Allegations Against Erika Jayne in Relation to Tom Girardi’s Crimes?

Erika Jayne‘s estranged husband, Tom Girardi, was indicted by a grand jury for embezzling more than $15 million from his clients, the Department of Justice announced Wednesday. PEOPLE reports that the once-famed attorney was charged with eight counts of wire fraud and four counts of criminal contempt of court. Tom’s son-in-law and former Girardi Keese colleague, David R. Lira, was also indicted along with the former CFO of Girardi Keese, Christopher Kazuo Kamon. Both were both charged with 12 criminal counts. The trio is “accused of stealing more than $3 million intended for relatives of victims killed in the crash of Lion Air Flight 610.”

“The substantial misappropriation alleged in this indictment compounded the grief and anguish of the clients who lost loved ones in the Lion Air crash,” U.S. Attorney John R. Lausch, Jr. said in a statement. “Attorneys who violate the trust of their clients and breach a fiduciary duty that is paramount to the practice of law must be held accountable.”

“The victims of this crime placed their faith in their attorneys during a time of great vulnerability,” Robert W. “Wes” Wheeler, Jr., Special Agent-in-Charge of the Chicago Field Office of the FBI, added. “Taking advantage of victims of tragedy is a despicable act, and we will continue to seek justice for anyone who takes advantage of innocent Americans in their hour of need.”

Girardi, Lira, and Kameron are accused of using the settlement funds for “improper purposes, including paying the firm’s payroll and operating expenses, and funding settlements to other Girardi Keese clients.” It is also alleged that the group tried conceal their crimes by blaming the COVID-19 pandemic. They also claimed that “serious issues” with Boeing delayed the release of the settlement funds. The incident notes that the trio knowingly made false claims, as Girardi Keese had already received the settlement funds from Boeing. As for Tom’s estranged wife, Erika Jayne, she has not been officially linked to any of his crimes to date. The Real Housewives of Beverly Hills star filed for divorce from her husband of 21 years in November 2020 as allegations against the now-disgraced attorney began to surface. Erika has been dragged into several civil lawsuits surrounding Tom’s crimes, alleging that she benefited from his misconduct during their marriage and may have even been “aiding and abetting” him. Erika has denied any knowledge of Tom’s crimes and maintains her innocence. She has yet to comment on the charges against Tom. The Real Housewives of Beverly Hills is expected to return for season 13 in 2023.
