Erika Jayne is facing another major legal development after a bankruptcy court approved the sale of a multimillion dollar claim tied to her ongoing case.

According to court documents, obtained by Daily Mail, a Los Angeles bankruptcy judge approved the sale of a potential $25 million fraudulent conveyance claim against Erika for $2 million. The claim was sold by trustee Elissa D. Miller to a third party, LHA Land LLC, which will now take over efforts to pursue the funds.

The lawsuit centers around allegations that expenses tied to Erika were paid using funds from her estranged husband Tom Girardi’s law firm. Erika has previously denied any wrongdoing and maintained that she was unaware of his financial issues.

Attorney Ronald Richards, who has been involved in the case for years, reacted to the court’s decision.

“I’ve spent five years pursuing Erika Girardi to bring justice to the victims of her husband’s fraud,” he said. “I am satisfied that those efforts have resulted in creating a value of $2 million to the trustees.”

He added, “Hopefully that money will go to reimburse the victims who lost their hard-earned settlements as a result of her husband’s fraudulent behavior.”

The ruling comes as Erika continues to navigate multiple legal battles following her split from Girardi in 2020 after more than two decades of marriage.

During a recent Real Housewives of Beverly Hills reunion episode, Erika addressed the possibility of losing the $25 million case.

“You can file for bankruptcy, or you can fight it out in court,” she said. “You can go to trial, you can cut a deal, you can die in the streets I have no idea.”

She also spoke candidly about the situation she finds herself in today.

“Why did he throw me out like that?” Erika said when asked what she would say to Girardi. “If you think about it, I’m in an almost impossible situation. I’m swimming under all of these lawsuits.”

Erika went on to describe what she says was a difficult dynamic in their marriage.

“I walked on ice a lot with Tom,” she said. “Looking back at it, it was always thin ice. It was constantly an interrogation it was constantly a battle.”

She added that there were periods where communication completely broke down.

“As sweet as Tom could be, is as vicious as Tom could be.”

Girardi was sentenced in 2025 to more than seven years in prison after being found guilty of multiple counts of wire fraud tied to misappropriating client funds.

As the legal process continues, the approved sale of the claim marks another significant step in the broader effort to recover money for victims connected to Girardi’s case, while Erika remains entangled in the ongoing fallout.

No matter how often she claims she has been exonerated, clearly she has not been if she is "swimming under all of these lawsuits.”

For anyone else confused as I am ... what this means is the original victims are tired of waiting and are now willing to accept crumbs, so they have given up their rights to the original $25M in exchange for (a percentage of) the $2M sale. But the third party (who now owns the lawsuit) can still go after Kunty ... they're simply in a better financial shape to ride it out. Some may suggest that these buyers are secretly in cahoots with Kunty, and may just drop the whole thing, meaning Kunty loses nothing. I'm still reeling from a short scene from several seasons ago when Kunty apparently slipped, and made a snarky comment, basically admitting that she's been with many men throughout her marriage. I was shocked it didn't make headlines. Even weirder was the fact that the ladies didn't even bat an eye.

That statement about Tom, "As sweet as Tom could be, is as vicious as Tom could be" describes Erika Girardi too. She can become ice cold and detached towards someone without warning. Even a loved one if it benefits her. Tom put himself first and so does she. That's the answer to the question she would ask him.
