Kandi Burruss and Todd Tucker’s split has taken another complicated turn, with new court filings pointing to a brewing custody battle and fresh scrutiny over their longtime prenup. And for fans who remember Mama Joyce’s years of hesitation about Todd, the latest developments are raising eyebrows.

According to Us Weekly, Kandi Burruss’ estranged husband, Todd Tucker, has officially requested primary custody of their two children and is questioning the validity of the prenuptial agreement they signed before their 2014 wedding.
On November 26, Tucker filed his response to Burruss’ divorce petition. In documents obtained by Us Weekly, the 52-year-old claims that their kids, Ace, 9, and Blaze, 6, are currently living with him in Georgia as Burruss fulfills “out-of-state work obligations.” He added that Burruss’ work commitments “will continue to require her to be away from the children for at least the next several months.”
Tucker noted that “the parties have been working cooperatively in an effort to resolve all issues, and [Tucker] remains committed to continuing those discussions in good faith.” However, if they can’t agree, he said he will be “seeking primary physical custody, joint legal custody and final decision-making authority.”
Despite the tension, Tucker acknowledged Burruss’ parenting in the filing, saying “that he recognizes [Burruss] as a loving and capable parent and remains sincerely hopeful that prior and continued discussions between the parties will bring full resolution of all matters.”
The filing also revisits the prenuptial agreement that has long been a topic of conversation on The Real Housewives of Atlanta — particularly with Mama Joyce, who never hesitated to voice her skepticism about Todd’s intentions. According to Us Weekly, Tucker suggested in the new documents that he was pressured into signing the prenup without proper legal representation.
His legal team claims the agreement “was presented to [Tucker], without [Tucker] having counsel, even though [Burruss’] then counsel had communicated previously with [Tucker’s team] regarding a potential prenuptial agreement.”
They further allege that “despite that knowledge, [Burruss’] counsel presented the final agreement to [Tucker] for signature immediately before the wedding ceremony, without any notice to or consultation with [Tucker’s team], who had been significantly engaged in the negotiation process.”
According to Tucker’s filing, “these circumstances raise substantial questions concerning the enforceability of said document. Nevertheless, [Tucker] remains committed to working in good faith to resolve this matter amicably and privately to the extent possible.”
Tucker is also asking for a “division of all marital assets, both real and personal, tangible and intangible” between the two.
And if the court ultimately finds the prenup invalid, Tucker is seeking primary physical custody, joint legal custody and potentially alimony.

Given the history — including Mama Joyce’s longstanding fears that Todd was not fully aligned with her daughter’s best interests — the unfolding legal battle is likely to spark even more conversation among longtime viewers who watched this relationship from day one.
