Vicki Gunvalson Nearing Victory As Her Ex-Boyfriend Brooks Ayers Is Ignoring Fraud Lawsuit

Vicki Gunvalson is close to victory in her legal battle with her ex-boyfriend, Brooks Ayers. The Real Housewives of Orange County star is heading towards a win against him because he’s ignoring the fraud lawsuit she filed against him. According to Radar Online, Brooks could be getting slapped with a default judgment at a court hearing in the near future. According to court documents obtained from Clark County District Court in Nevada, a default hearing has been set for November 8th, 2019.

Brooks was served in May of 2019, but he has not responded to the lawsuit at all yet. Vicki had sued Brooks for breach of written agreement, breach of verbal agreement, and fraud. Plus, Vicki claimed that he owes her over $266,000 dollars.

In the complaint filed, it stated, “Commencing in or about 2011, Plaintiff Gunvalson and Defendant Ayers entered into a series of loans wherein Ayers borrowed various amounts of money from Gunvalson and Gunvalson agreed to loan such amounts to Ayers. Ayers acknowledged the balance due on the loans in the amount of $184,899 to Gunvalson. Ayers agreed to provide an accounting of all sums paid to him in various income streams.”

She claimed that he breached the agreement by not paying her back at all. Plus, she claimed he didn’t provide accounting as it was stated in the terms of agreement. Back in 2013, they were in litigation in Clark County, Nevada. They had incurred legal fees through April of 2015. According to court papers, “Ayers was unable to pay his portion of the attorneys’ fees and costs incurred on his behalf in the litigation. The Parties entered into a verbal agreement wherein Ayers borrowed $81,652,97 from Gunvalson to pay for the legal services, attorneys’ fees and costs incurred in the Las Vegas litigation.”

Vicki stated that Brooks “had no intention of ever repaying either of the loans.” In fact, Vicki accused him of “concealing and continuing to conceal accounting of his records” to “intentionally defraud and oppress Plaintiff.” Vicki is seeking over $15,000 dollars, her attorneys’ fees, costs that have incurred, on top of interest. It read in statements that Brooks has “failed and continued to fail to remedy or make good on the said account to Gunvalson.”

Vicki and Brooks broke up in August of 2015. Their rocky relationship was played out on the RHOC. Brooks admitted to forging medical records, and it was well documented on the show that he claimed he had cancer. Brooks alleged that he suffered from Stage 3 Non-Hodgkin’s Lymphoma. Despite forging medical files, Brooks still says to this day that he was diagnosed with cancer. He remarried and lives in Mississippi, while Vicki is happily engaged to Steve Lodge.
