Denise Richards’ Husband Fights Court Attempt to Garnish Her Wages for His 228k Debt

Money troubles are rarely just about the person who owes — sometimes they spill over to affect loved ones. That’s exactly what’s happening to Denise Richards and her husband, Aaron Phypers. According to court documents obtained by InTouch Weekly, Aaron’s creditors are trying to seize Denise’s wages to pay off his $228,000 debt, but Aaron is fighting back hard.

The trouble began after Aaron, 52, took out a $190,000 business loan in 2019 with an 11% interest rate. After defaulting, the Creditors Adjustment Bureau sued him and his wellness company in 2022. Now, they want to collect the money by garnishing Denise’s paycheck.

A lawyer for the creditors stated, “Denise Richards currently is, and at the time the debt was incurred was, the spouse of Defendant and Judgment Debtor Aaron William Cameron Phypers aka Aaron Phypers aka Aaron W. Phypers and is responsible for the community property debts.” They’re asking the court for an order “attaching the wage earnings and other assets in the name, possession, custody, and control of Denise Richards.”

But Aaron’s side isn’t backing down. His attorney argues there is “no admissible evidence that Aaron and Denise are actually married.” The attorney also objected to media reports used as evidence, calling them “inadmissible hearsay and not competent evidence.”

Furthermore, Aaron’s lawyer said, “Judgment creditor presents no evidence that Aaron and Denise’s assets are community property. An attachment order or other collection order that permits recovery from unspecified assets is inappropriate and overly broad, potentially permitting seizure of assets that are not community property.”

The court documents also discuss how community property laws can be complicated. “While marital earnings, assuming the two are married, are generally community property, that is not necessarily the case. Married couples can enter into transmutation and other agreements that change the character of assets and earnings,” the filing notes. Plus, the creditor’s failure to properly notify Denise “precludes her from presenting evidence” that could protect her income.

Denise Richards is not involved in the loan, and Aaron admits he failed to make payments because he lacked the funds. A 2023 settlement required Aaron to make substantial monthly payments through early 2025, but he’s been accused of missing those payments.
