“The Trustee contends that Ms. Girardi knowingly and willingly participated in Mr. Girardi’s criminal enterprise and the money used to pay her business expenses were monies from that criminal enterprise.”

The lawsuit suggests that Jayne, who has long maintained her innocence, used Girardi’s personal American Express credit cards to cover expenses related to her entertainment career. This includes charges for services and products that allegedly supported her efforts as an entertainer, actor, singer, and writer.

It’s the proving it was knowingly and willfully . Up until he was busted , Erika held him in high regard as an attorney as did MANY others . I’m sure there is no way in hell he told her anything he did that was illegal especially if he wasn’t that great of a hubby- she would’ve told , she would’ve left spilled his tea blew his cover etc.. I guess we shall see . I’m not jealous of prosecution or defense in this one . People that hate her from tv automatically say guilty , just because . People that are married to career successful individuals don’t know or believe their spouse would do this

You may be right but I still think she suspected at the very least. She's not a stupid person. Isn't that why she said she woke up terrified every morning during Covid because the courts were closed. And at the first sign of trouble, she left him after dropping him off at work. I think she knew all hell was about to break lose because he was old now and not able to come up with something to smooth it out. He probably already had the first signs of dementia as witnessed by that car crash. EJ knew the end had arrived.

The numbers don't add up. He was accused of taking 15 million ( I thought it was much higher) but has to pay restitution of only 3.7 million. And if he was accused of taking 15 million why is she being sued for 24 million. Having said that, I always thought she suspected what was going on...she isn't stupid and she did benefit but she didn't legally participate as she wasn't a member of that firm. So, not sure how this plays out.

Exactly! All this bs is a distraction and Tom, though guilty as hell, is the fall guy for something that reaches FAR beyond even his grubby little fingers, and I’m not talking about Erika. Nope, I’m talking about the people who made it even POSSIBLE for Tom to not only do this FOR DECADES but get away with it (unto greasing THEIR grubby paws and lining THEIR filthy pockets.) And while Erika MAY or MAY not be inclusive in that group, she ain’t alone nor the most egregious in her wrongdoing. ? I don't think at the time, she was "playing a part". We're talking a starry-eyed stripper wife #3 here from the GA sticks, who married for money. From the relationship we saw on television, I can't even fathom him sharing the sordid details of his ill-gotten gains with her. I suspect he was way too proud to even let her know that he was in the financial straights.

When I was growing up, my dad was a stock broker/financial planner with countless clients. Although he certainly "brought his work home" on occasion (to our chagrin), I can assure you my mom (like most wives back then) never knew (or cared) to know the specific details of his work. In fact, she could barely balance a checkbook. I don't think things are all that different today, and Kunty is no spring chicken.

Oh, I don't think he ever directly told her. It's not like he sat down and said Erika, this is how I make my money...no, but she's not stupid. Lawyers don't live the way he was living...even very successful lawyers. Tom had a network set up that he paid to hide his crimes for decades and as long as everyone eventually got their money, what was the harm? Until Covid and dementia and the whole thing collapsed.

What I mean is EJ received funds directly from her husband's firm...or am I missing something? She didn't use money from their personal joint bank account that is a few degrees removed from Tom's crooked, trust money grabbing law firm. This is why she's implicated. Her LLP was funded by Tom's law firm. Or at least, that's what I've read.

Even her lawyer is not disputing that, but it gets dicey because Girardi/Keese's Chief CFO was funding 127 other accounts as well. In many industries, it just comes down to good old fashion "commingling". My industry doesn't allow it, because there are laws in place which requires my client's monies (earnest checks) go directly from my hands and into a escrow account at a title co.(in a timely manner!). What it comes down to is there is apparently zero evidence that EJ was aware of anything, which is why she hasn't been charged.

And stop saying Tom legally earned his pay (or anything for that matter), when he overspent, stole from victims and couldn't cover his own firms operating budget/existence. In the end, Erikunty and Tomfoolish STOLE PeriodT. There's no earned anything when you are always making poor decisions, choosing FRAUD and in HUGE MASSIVE DEBT.
