RHOBH Star Erika Jayne Could Lose A Million Dollars If Tom Girardi Is Convicted of Fraud Plus, Erika Comments On Tom Being Found Competent to Stand Trial

RHOBH star Erika Jayne is at risk of losing at least one million dollars in her divorce from estranged husband, Tom Girardi, amid his legal issues.

Tom Girardi’s legal woes are once again affecting his estranged wife Erika Jayne. Currently, the once famed lawyer is in the middle of a criminal fraud trial and was recently found competent to stand trial despite claiming he has dementia. 

While many Real Housewives of Beverly Hills fans have speculated about Erika’s possible involvement in Tom’s alleged fraud, there has been zero evidence tying her to his crimes. 

Still, Erika did file for divorce from Tom in November 2020, just a month before he was criminally charged for embezzling settlement funds from the clients of his Girardi Keese law firm. 

Since 2020, the criminal charges against Tom and his subsequent bankruptcies in 2021 have halted Erika and Tom’s divorce proceedings.

However, now The U.S. Sun reports that Erika could face even more losses when it comes to her divorce from Tom if he gets convicted of fraud. And it’s currently not looking great for the former attorney. 

If Tom is convicted of fraud, it will affect the RHOBH star’s wallet. According to lawyer Ronald Richards, Erika could loose one million dollars on top of “exempt property payouts from the bankruptcy estate.” 

“Her divorce has been sitting on ice since 2021. They’re doing nothing in that case,” Richards explained. “She is set to get half of whatever remains after the bankruptcy case, some things are exempt and there are community assets. But if he’s convicted a restitution order could attack whatever is left, and she could lose out, as well as be on the hook for lifetime alimony payments.”

Basically, if there was theoretically any money left after the bankruptcy case, that doesn’t take into account the restitution Tom may have to pay if convicted of fraud. 

Richards noted that Erika was “not happy” Tom was found competent to stand trial. 

Meanwhile, Erika appeared on the January 17 episode of Watch What Happens Live With Andy Cohen

During the appearance, Andy Cohen asked the RHOBH star, ” Do you still speak to him?” referencing her estranged husband, Tom. 

“No,” Erika replied.

The RHOBH star continued, “I thought I told you this, the day I euthanized my dog [Tiago in October] that was the last day. I couldn’t take it. I was literally holding my dog. He was dying in my arms and Tom kept calling. I was like, ‘I can’t do this any long.’ That was it.” 

Andy followed up, stating, “I haven’t spoken to you since Tom was ruled fit to stand trial, what is your reaction?” 

“Competent under the law, I’m not sure what the bar is,” Erika quipped. “I can only speak for what I know and what I lived, which is completely different.” 

“Do you think he is competent to stand trial?” Andy asked, to which the RHOBH star replied, “I don’t know. I’m not a lawyer.” 

The Real Housewives of Beverly Hills airs on Wednesdays at 8 p.m. ET on Bravo.

It sure doesn't appear that way at all. He was on the show while and after the stealing took place, right? It could be the beginnings of either now but not at the time the crimes were committed nor even now to continue to stall to get out of standing trial. If he is good enough legally now, then it would be fair to assume he was however many years ago when the crimes were committed and continued to be covered up. ? It is just what people with money can and will do to stall.

People forget just how legitimately wealthy TG was for many many decades (hundreds of millions), so it's just very difficult to distinguish THAT money from monies that he allegedly pilfered from clients. Also, I'll never understand how the wifey who had NOTHING to do with her husband's business dealings would be held accountable. Kunty left with nothing, and is living in a 900 sq. foot space; what more do people want? Do people sue a surgeon's wife for malpractice? Seems to me the mailroom boys at Girardi/Keese would be more liable.

Why should she ... who says they were bought with fraud money? Kunty's name wasn't on the door at the law firm, so therefore she's not liable. Should she return and sell everything he ever gave her in the 20+ yrs. of matrimony? Also, it's very apparent that the G's apparently said hello and goodbye to each other a few times a month. BTW, I don't even like her; I'm just playing devil's advocate.

The funny thing is didn't she brag about "knowing enough about the law, I could be a lawyer" or something like that? She gets a hefty bravo salary and all her side jobs and has debt. Weight loss drugs aren't cheap, either. Forcing Tom to stand trial has to be worrying her and I think it is great!

Oh honey, Kunty ain't bagging it up at Aldi; that's for sure. My point was she was cut off from all of Tom's (ill gotten?) money when she bolted. This we know. But as @sswipe Cohen reminded her at the reunion "I know what you make from the show". Also, let's be real; she was probably siphoning a lot of ca$h for quite a while before she left Sleeping With the Enemy style.

Since we're going to split hairs, allow me to clarify. "900 sq. ft." was an exaggeration, and figure of speech. I haven't taken a measuring tape to the property, but from the online images, it is tiny. The $1.5M asking price (before renting it) about says it all. I'm glad I didn't say use my usual "Cracker box" analogy or some might think that I think Kunty is a Keebler Elf. But this I can guarantee with almost certainty; that Hancock Park (adjacent) bachelorette bungalow is tiny (even using the notorious wide angle lens that can make refrigerators look their 8 ft. wide. As a realtor/builder, I laugh all the time at these wild calculations where home sq. footage is routinely exaggerated, and Bravo's fame ho's are the worst offenders. Now speaking of home sq. footage, I must get the F outta here and go do some Sunday touring. Arrivederci amore mio ??.

After looking at the inside, there is no mistaking it isn't close to 900 square feet or a cracker box. I'd guess 1,600 (which also isn't a cracker box) but it has an upstairs so it could be close to 2,000. Did she move since the first one... Maybe you do think she's an elf!

Really! That is why she filed for divorce a month before it hit the fan. Before, she figured there'd be money to pay someone else to do that. Even now, there is a whole lot of money going out every month to pay for his place, more than where she lives. Where is it coming from exactly. Him standing trial is probably going to be a nightmare for both.

I really don’t care one way or the other for Erika. I’m one of the few that never had a strong opinion of her from the get go. And that never really changed. So, I’m about as objective a viewer concerning her as you can get. What I couldn’t help noticing reading this article is just how much Ozempic (er…I mean, ‘menopause’ ?) has wreaked havoc on Erika’s looks. Say what you want about her character (no really, say it ?) but she was STUNNING at one time! Since Ozempic, she just looks emaciated and aged. She’s still somewhat attractive (physically), but she’s lost a lot of the lushness and voluptuousness that was crucial to her overall beauty and appeal. Oh well. ?

Oh, I said something similar (somewhere) about her making a mistake by losing the weight. However, she probably won't be in "show business" ever again so it won't matter. She was talking about working as a dominatrix a while back and there is always onlyfans I suppose but the old look would be better for those "careers", too, I think. Ha.

Her legs look like toothpicks, soon she'll be a bobblehead. Ozempic causes muscle not fat loss, it's a dangerous drug if not prescribed correctly. Ppl are suffering serious health issues up to and including death. Stomache paralysis is the latest.

And as someone who’s typically been underweight most of her life, I can attest that being skinny is not the end all be all. It really isn’t. If it were, I’d have no problem saying so. And even though those words will fall on deaf ears for the most part, I hope these two words don’t: PERMANENT DIARRHEA. ?

We're still awaiting the toxicology report on a family member who died in ER 4 months ago, went there with severe abdominal pain. The remaining 3 syringes of a pkg of 6 were in her fridge with no ID other than lable from a Mexican pharmacy. She looked great, had lost about 40lbs, that really didn't need losing, attributed it to keto and a personal trainer, couldn't hide the Ozempic face though. Vanity kills.

That’s really heartbreaking ? I think it’s just a matter of time until the onslaught of lawsuits begin. This drug MAY be a boon to those who really need it (time will tell), but it’s FAST becoming a nightmare for those who don’t but just want to be thinner. You shouldn’t have to die just cuz you want to be thin! ?

They are foolish because the risks are greater than the benefits for those not technically obese (based on BMI) which is none of them. Surely none of them wore more than a Size 12, even the taller beefier ones! So everyone else's health care costs go up in a year or so because of people like them suing doctors and drug manufacturers when things go bad.... Stomach and intestinal issues seem like the most likely problems based on how they are supposed to work.

It doesn’t really bother me. Once I turn off the show, these people pretty much cease to exist in my world (except to come here and snark on them like the gossip ghoul that I am. Lol). I figure if there’s anything they can legitimately get Erika for, they will. And if she’s slippery enough to slide by them (*cough Phaedra Parks cough*), there’s the ultimate judgment on Judgement Day so I ain’t worried about it. ????

It doesn't me, either but when I'm here, I judge, not that they know or care! I'm watching old NY episodes lately for the first time. It is way more interesting than anything I've watched for years on these shows but starting to get dark as of Season 4. Not a gang up like BH or old vendetta like NJ, but the fighting and nastiness is out of control.

Yeah, I’d be surprised if any of the franchises survive more than a couple of more seasons. The shows have just strayed too far from the original premise. And the original premise had a shelf life. I.e., we’ve gotten our peek behind the gates of the privileged, now what? To be fair, SOMETHING had to be introduced to keep viewers interested. Bravo chose poorly imo with too much fakery and too much nastiness. I say stick a fork in RH altogether, it’s done. ?

I'm on Season 4 reunion(s) of NY now and they do have expiration dates yet they keep going and get stinky as the years go on. Sometimes it is bringing in new ones that are awful and sometimes it is keeping old ones far too long.

I cannot stand Erika and she is a primary reason I only read an occasional recap of this city. Won't watch and give it ratings. She is at heart a woman who abandoned her kid to be.stripper and chase/marry old men. She then colluded with him to steal from his clients who received settlements. Gross.
